1. Personuppgiftsansvarig och definitioner
- Personuppgiftsansvarig för kunder/användare av webbutiken, även kallad Säljaren, är: Teresa Konopka "CONTESSA" ZAKŁAD KRAWIECKI, GOLD HOTEL, telefon: + 48 660 473 269, momsnummer (NIP): PL7351001201, organisationsnummer (REGON): 490236540.

- Användare – en fysisk person som besöker webbutikens webbplats(er) eller använder tjänster eller funktioner som beskrivs i denna Integritetspolicy och Cookiepolicy.
- Kund – en fysisk person med full rättshandlingsförmåga, en konsument, en juridisk person eller en organisation utan juridisk personlighet men med rättskapacitet enligt lag, som ingår ett distansavtal med Säljaren.
- Webbutik – den internetbaserade tjänst som drivs av Säljaren och som är tillgänglig via: https://andrzejkonopka.se, där kunden/användaren kan få information om produkter, deras tillgänglighet samt köpa varor eller beställa tjänster.
- Nyhetsbrev – information, inklusive kommersiell information i enlighet med lagen (2002:562) om elektronisk kommunikation, som skickas av Säljaren till kunden/användaren via e-post. Prenumeration på nyhetsbrevet är frivillig och kräver samtycke.
- Konto – en uppsättning data lagrade i webbutiken och i säljarens IT-system, avseende en specifik kund/användare samt deras beställningar och ingångna avtal. Genom kontot kan kunden/användaren göra beställningar och hantera sina uppgifter.
- GDPR – Europaparlamentets och rådets förordning (EU) 2016/679 av den 27 april 2016 om skydd för fysiska personer med avseende på behandling av personuppgifter och om det fria flödet av sådana uppgifter.
2. Syften, rättslig grund och lagringstid för databehandling
- För att genomföra distansförsäljningsavtal behandlar Säljaren:
- information om användarens enhet för att säkerställa korrekt funktion av tjänsterna: IP-adress, information i cookies eller liknande teknologier, sessionsdata, webbläsardata, enhetsdata, aktivitetsdata på webbplatsen, inklusive undersidor;
- geolokaliseringsinformation, om användaren har samtyckt till åtkomst till platsdata, för att kunna tillhandahålla mer anpassade erbjudanden;
- användarens personuppgifter: namn, adress, e-postadress, telefonnummer, momsnummer, bankkontonummer eller andra nödvändiga uppgifter för att kunna genomföra köpet.
- Dessa uppgifter identifierar normalt inte användaren direkt, men i kombination med annan information kan de betraktas som personuppgifter och skyddas därför fullt ut enligt GDPR.
- Behandlingen sker enligt artikel 6.1 b GDPR (avtalets fullgörande) samt artikel 6.1 a GDPR (samtycke till cookies eller platsdata). Uppgifterna behandlas tills användaren/kunden slutar använda webbutiken.
- Personuppgiftsansvarig vidtar alla tekniska och organisatoriska åtgärder som krävs enligt artikel 32 GDPR för att säkerställa en säker nivå som motsvarar riskerna.
3. Marknadsföringsåtgärder
- Webbplatsen kan innehålla marknadsföringsinformation om Säljarens produkter eller tjänster. Visningen av sådant innehåll grundas på artikel 6.1 f GDPR – Säljarens berättigade intresse att marknadsföra sina tjänster utan att kränka användarnas rättigheter och friheter.
4. Mottagare av personuppgifter
- Personuppgifter lämnas endast ut till personuppgiftsbiträden som enligt avtal behandlar uppgifter för Säljarens räkning, t.ex. leverantörer av hosting, IT-tjänster, marknadsföring och PR.
5. Överföring av personuppgifter till tredjeland
- Personuppgifter behandlas inte utanför Europeiska unionen (EU) eller Europeiska ekonomiska samarbetsområdet (EES).
6. Registrerades rättigheter
- Varje person vars uppgifter behandlas har rätt att:
- få tillgång till sina uppgifter (artikel 15 GDPR);
- få en kopia av sina uppgifter (artikel 15.3 GDPR);
- rätta felaktiga uppgifter (artikel 16 GDPR);
- begära radering av uppgifter (artikel 17 GDPR);
- begränsa behandlingen (artikel 18 GDPR);
- överföra sina uppgifter (artikel 20 GDPR);
- invända mot behandlingen (artikel 21 GDPR);
- återkalla samtycke när som helst utan att det påverkar lagligheten av tidigare behandling.
- För att utöva dessa rättigheter ska den registrerade kontakta personuppgiftsansvarig via de kontaktuppgifter som anges i punkt 1.2.
7. Tillsynsmyndighet
- Den registrerade har rätt att lämna in klagomål till tillsynsmyndigheten. I Sverige är detta Integritetsskyddsmyndigheten (IMY), Box 8114, 104 20 Stockholm, https://www.imy.se.
8. Dataskyddsombud
- Den registrerade kan när som helst kontakta Säljarens dataskyddsombud via e-post eller skriftligen till adressen som anges i punkt 1.2 i denna Integritetspolicy och Cookiepolicy.
9. Ändringar av integritetspolicyn
- Denna Integritetspolicy och Cookiepolicy kan uppdateras eller kompletteras vid behov för att säkerställa aktuell och korrekt information till kunder/användare.

- Webbutiken samlar in information om kunder och användares beteende genom:
- frivilligt inmatad information i formulär;
- lagring av cookies på användarens enhet;
- insamling av serverloggar av webbutikens hostingoperatör.

- Kunden kan när som helst avsluta prenumerationen genom att klicka på länken i nyhetsbrevet eller via formuläret https://andrzejkonopka.se/newsletter.php.
12. Konto
- Kunden/användaren får inte publicera olagligt innehåll i webbutiken.
- Konto skapas efter registrering och ger tillgång till beställningar och uppgifter.
- Vid registrering lämnas uppgifter som namn, företagsnamn, momsnummer, adress, e-postadress och lösenord. Genom att registrera sig bekräftar kunden att uppgifterna är korrekta och att villkoren har godkänts.
- Genom att skapa ett konto ingås ett avtal om elektroniska tjänster på obestämd tid. Konsumenten kan säga upp avtalet enligt villkoren i Reglerna.
- Kunden/användaren kan när som helst avsluta kontot genom att kontakta Säljaren via e-post eller brev.
- Säljaren kan säga upp kontot i händelse av regelbrott eller inaktivitet under 6 månader, med sju dagars uppsägningstid.
